Rospatent must register the Moscow City trademark. This decision was made by a court based on an application submitted by PAO City. The new brand will be applicable to a wide range of industries, including construction, space rental, entertainment, and more.
To date, the company's requests have been partially satisfied. The submitted application covered a variety of products and many types of services.
According to the court's ruling, the new brand will represent services designated in the International Classification of Services (ICS) as Class III. This list includes:
-
real estate transactions;
-
office space rental;
-
construction of buildings;
-
education;
-
work of museum institutions;
-
leisure activities.
A little background: in the fall of 2019, City's application to register its own trademark was rejected by Rospatent. The agency reported that the English-language designation "Moscow City," which translates as "Moscow City," lacked distinctiveness. Rospatent believed that consumers would not be able to treat it as a trademark.
In response to this statement, PAO City emphasized the widespread recognition of the Moscow City designation and its distinctiveness. In the summer of 2018, over 1,500 small and medium-sized businesses, retail outlets selling industrial goods, pharmacies, medical facilities, and other businesses operated within the MIBC. A skyscraper museum operated on the 56th floor of the "Empire" tower structure, and high-rise construction work was underway. Rospatent rejected the objections in December 2020.
By filing a lawsuit, PAO City insisted on overturning the department's decision. Initially, the request was denied. In the summer of 2021, the request was finally granted. Rospatent reconsidered the company's objection but again denied the trademark registration. In March of that year, PAO City filed another lawsuit, after which the patent office received an order requiring registration of the "Moscow City" trademark (for certain categories of services and products mentioned in the application).
