The land dispute on Shmitovsky Proezd has taken a new turn. The company “Lissel,” which is planning an office project near Moscow City, is demanding that Russian Railways dismantle the supports and the MCD-4 overpass located within the boundaries of the two plots. The Telegram channel “Stroiki — i Tochka” reported on the lawsuit on October 14; Kommersant published the information, citing the channel.
According to the channel, the Moscow Arbitration Court has accepted the claim for consideration. However, the publication contains no information about a court ruling ordering the structures to be demolished.
According to the description of the lawsuit provided in the media, “Lissel” is seeking an order requiring Russian Railways to remove the structures within 45 days after the decision becomes final. In the event of non-compliance, the company is seeking a judicial penalty of 10,000 rubles per day and the right to independently remove and dispose of the structures at the railway company’s expense.
These are the plaintiff’s demands. There is no basis for presenting them as an approved dismantling plan or announced changes to train schedules.
The background to this is confirmed by a separate court case, No. A40-131681/2023. In that case, Russian Railways (RZD) had already acted as the plaintiff and sought the expropriation for public use of a 1,785 m² plot on Shmitovsky Proezd. According to the published text of the court ruling, “Lissel” was using this land under a lease.
Russian Railways sent the draft expropriation agreement to the company in October 2022. The parties failed to agree on the amount of compensation, after which the dispute went to court. Thus, the current announcement regarding the demolition has a documented history related to the land and compensation. However, the old expropriation case and the new demolition lawsuit are separate proceedings.
MCD-4 is part of the business district’s transportation infrastructure: previously, this portal reported on the opening of the northern entrance to the “Moscow City” station on the Fourth Diameter. Now, the focus has shifted to a land dispute near the railroad tracks.
